What is ICS2?

ICS2 stands for Import Control System 2. It is an upgraded electronic customs import system for the European Union (EU). The system is designed to collect data about all goods entering the EU prior to their arrival.

The system is intended to reinforce customs risk management in an integrated EU approach. The system is being implemented in two releases, with the second release being implemented on March 1st, 2023.

ICS2 is aimed at better protecting the single market and EU citizens by collecting data about all goods entering the EU 24 Hours before Loading on Origin Port.

It will depend on the type of services that they provide in the international movement of goods and is linked to the three Release Dates of ICS2.

1.  March 15, 2021.

2.  March 1st, 2023.

All goods being shipped into or transiting through the EU*, Northern Ireland, Norway and Switzerland by AIR will need to file ICS2 Air.

3.  June 3, 2024.

Beginning June 3, 2024 these requirements will extend to Road, Rail and Maritime shipments.


Who is affected by ICS2?

ICS2 is the EU customs advance cargo information system. It will be implemented to gather data on all goods destined to enter or to transit via the EU before they reach the EU’s external borders. This means it will have a direct impact on all economic operators involved in the dispatch, transport and handling of international freight, express or postal consignments.

The following economic actors are directly affected by ICS2 and will each have to provide safety data for ICS2:

•    Postal operators inside and outside the EU;

•    Express carriers

•    Air cargo carriers

•    Freight forwarding and logistics companies

•    Final consignee established in the EU (for goods received by sea)

•    Sea, rail and road transport carriers

•    Representatives of all the above-mentioned actors.


Benefits of ICS2?

ICS2 introduces more efficient and effective EU customs security and safety capabilities that will:

•    Increase protection of EU citizens and the internal market against security and safety threats

•    Allow EU Customs authorities to better identify high-risk consignments and intervene at the most appropriate point in supply chain

•    Support proportionate, targeted customs measures at the external borders in crisis response scenarios

•    Facilitate cross-border clearance for the legitimate trade

•    Simplify the exchange of information between Economic Operators (EOs) and EU Customs Authorities.


How to get ready for ICS2?

To get ready for ICS2, you can take the following steps:

•    Have a customs consultant give your supply chain a quick scan to identify any potential risks and ensure that your core processes are compliant.

•    Obtain Authorized Economic Operator (AEO) accreditation, which is a certification that demonstrates your company’s compliance with customs regulations and security standards.

•    Use a digital, end-to-end customs agent to minimize the risk of errors in data input.

•    Ensure that your IT systems are updated to comply with the new regulatory requirements.

•    Provide training support to your staff to ensure that they can provide all the necessary high-quality data required by ICS2 and support required actions in case of customs referrals.

•    It is important to note that every economic operator directly affected by ICS2 needs to align its business processes with the regulatory requirements implemented via the new system.

If economic operators are not ready on time and do not provide the necessary ICS2 data, consignments and freight will be stopped at the EU customs borders, and inadequate declarations will either be rejected or subject to intervention, with penalties imposed for non-compliance.

What will happen if economic operators are not ready on time?

If economic operators are not ready on time and do not provide the necessary ICS2 data, consignments and freight will be stopped at the EU customs borders and the goods in question will not be cleared by the customs authorities.

Furthermore, inadequate declarations will either be rejected or subject to intervention, with penalties imposed for non-compliance.
